Hi everyone

I am always impressed with the depth of knowledge the community has and wonder if anyone can answer this conundrum. 

I am an Irish Citizen , unfortunately my British wife of 48 years never applied for Irish Citizenship before 2012 when it would have been granted automatically. We have holiday apartment in Italy and understand post Brexit, non EU citizens can only stay for 90 days in any 180 days . I am exempt from this rule but will I have to just observe the time limitations, send my wife home and stay alone , or is she exempted from the rule as married to and living with an EU Citizen .

If you stay for more than 90 days you would have to apply for residency in your comune.  Your wife would have to apply for a Permesso di Soggiorno for 'ricongiungimento familiare' which would allow her to stay with you.   If you stay for more than 90 days under the radar then your wife only has the option of a visa for residenza elettiva and then a permesso di Soggiorno.
